When someone passes away without a Will it is usually referred to as passing away ‘intestate’. There are specific ‘rules of intestacy’ which set out how the deceased’s assets are to be dealt with and distributed, and who will be responsible for administer

In this chapter we’re going to ask about the key members of the deceased's family. This will give us the background we need when we discuss how the estate will be administered and distributed.

When answering these questions, please include anyone who themselves have passed away.

If you are unsure of any family member’s details, then please still include that individual, and provide as much information as possible. This might include ‘partners’ or de facto relationships, or step-relationships.

If the funeral director’s invoice has not yet been paid, it can likely be paid from one of the deceased's bank accounts. If you or someone else has already paid for the funeral, that cost can be reimbursed once probate is granted.

Examples of substantial liabilities include mortgages, loans, large credit card balances, or significant tax bills.

Dealing with a deceased estate can be complicated, and you might have concerns that we can assist with. If you do have any concerns, or you think that others might raise issues, it would be helpful if you could let us know now so that we can address them when we meet. These might be about:
  • Particular family members
  • Assets of the estate, or
  • the capacity of the deceased.
